英国引入延伸性集体管理的论争及其启示

摘要(Abstract)：
延伸性集体管理制度作为发源于北欧斯堪的纳维亚法系的一项特殊制度工具,在互联网对版权起到深刻影响的今天备受各国立法者的重视,因为它迎合了数字化时代下大规模授权和降低著作权集体管理组织交易成本的需求。受此影响,英国进行了数字时代下的集体管理模式变革,并拟定了《2014延伸性集体管理制度法案》,正式引入该制度。我国正在修订中的《著作权法》也吸收了该项制度。本文具体分析了英国移植北欧延伸性集体管理制度的背景、过程和成果,并将其与发源地国进行制度设计上的对比,从而为我国移植延伸性集体管理制度提供参照经验。
